1. Objective

This privacy policy (“Policy’) is an electronic record under the Information Technology Act, 2000, and the Rules made there under and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000, from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures to make the terms of this privacy policy binding.

This Policy is published under the requirements specified by the Information Technology (Reasonable Security Practices and procedures and sensitive personal data or information) Rules, 2011, made under the Information Technology Act, 2000.

This Privacy Policy describes the policies and procedures on the collection, use, disclosure and protection of your information when you use our Mobile Application (collectively, “DSG APP”).

For the purpose of this Policy, terms “you” and “your” refer to the user of the DSG APP & the terms "our", "ourselves", "we" and "us" refer to Dharampal Satyapal Limited which includes its associates, affiliates, group companies, and subsidiary(ies) unless the context clearly provides otherwise. The term “Services” refers to any services offered by us whether on the DSG APP or otherwise

Please read this Policy before using the DSG APP or submitting any personal information to DSL. This Policy is a part of and incorporated within, and is to be read along with, the applicable Terms and Conditions based on the user of the DSL Platform.

By using the DSG APP, you agree and consent to the collection, transfer, use, storage, disclosure and sharing of your information as described and collected by us in accordance with this Policy. If you do not agree with the Policy, please do not use or access the DSG APP.

2. Scope

Dharampal Satyapal Limited built the DSG APP as a Free App for individuals, including its current and prospective employees. For the purpose of this policy the term “employee” (including full time, part time and contract employees) any individual who is on our Payroll. 

This policy outlines Dharampal Satyapal’s practices for collecting, using and disclosing employee personal information. It is subject to the provisions of applicable privacy laws and does not seek to replace or over-ride those laws. 

We recognize the importance of maintaining your privacy. We value your privacy and appreciate your trust in us. This policy how we treat the information we collect from you. We will not use or share your information with anyone except as described in this Privacy Policy.

The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at DSG APP unless otherwise defined in this Privacy Policy.

3. DEFINITIONS

Unless otherwise provided in this Privacy Policy, the terms capitalized in the Privacy Policy shall have the meaning as provided hereunder:

  1. Account: means a unique account created by you or on behalf of you to access our Service or parts of our Service at DSG APP.
  2. Cookies: are small files that are placed on mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.
  3. Country: refers to India or any country where we provide our Services
  4. Data Controller: means the entity which provides services to its end users (individuals – ‘providers of information’ under the ITAA 2008) under a direct relationship and determines the means and purpose of data collection and processing.
  5. Data Processor: means the entity which provides services to its clients (organizations) under a lawful contract having an indirect relationship with the end customers (providers of information) as per the instructions from the Data Controller; e.g. business process outsourcing service providers and also includes any entity processing Personal Data on behalf of and as per instructions of the Data Controller.
  6. Data Subjects: Any natural or legal person/individual who provides personal information/ Personal Data to the Data Controller, which for the purpose of this Policy is you.
  7. Device: shall mean mobile or other device used to access the DSG APP.
  8. Device Identifier: shall mean IP address or other unique identifier for the Device.
  9. Information: shall mean any information provided by you on DSG APP including but not limited to the Personal Data/Information as defined below.
  10. Mobile Application shall mean an application provided by us on the Device to access the Services.
  11. Mobile Device Information shall mean information pertaining to IMEI device ID, login ID, and other information from within the mobile device.
  12. Personal Data/ Information: any information that relates to an identified or identifiable individual.
  13. Protected Information shall mean such categories of information that could reasonably be used to identify you personally, including your name, e-mail address, and mobile number.
  14. Service: refers to the services offered on the mobile application.
  15. Third Party shall mean a third party service provider.

While using DSG APP Service, We may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. When you sign up to use the Services, you create a user profile. We shall ask you to provide only such Protected Information which is for lawful purpose connected with our Services and necessary to be collected by us for such purpose. Personally identifiable information may include, but is not limited to:

Usage Data is collected automatically when using the Service.

Usage Data may include information such as your Device's Internet Protocol address (e.g. IP address), camera, location, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device's unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

We may also collect and use technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates and other services to you (if any) related to such Mobile Applications.

Information Collected while Using the Application

You can enable or disable access to this information at any time, through your device settings.

We want to inform you that whenever you use our Service, in a case of an error in the App we collect data and information (through third-party products) on your Device called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

The information that we request will be retained by us and used as described in this privacy policy.

CONSENT WITHDRAWAL 

If any stage, you wish to withdraw your consent, you need to send a written request regarding the same to the Data Protection Officer and to the extent applicable, state the reasons behind such withdrawal. Upon receipt of your application, we will provide you with the response on the same at the earliest after conducting an assessment if required. Please note that from the date your withdrawal application is accepted by us and notified to you, you will no longer be able to access the DSG APP. Post the same, we will not be processing your information, unless we have any other legal basis to do so.

JURISDICTION

If you choose to access DSG APP, any dispute over privacy arising from your access to the App, is subject to this Policy and the App's terms of use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India and shall be under exclusive jurisdiction of the Courts located at New Delhi.
